Official Rules
CONTEST DESCRIPTION:Contest "Lost Ark: Rooster Emote Design" ("Competition”) starts around May 22, 2023 at 00:01. m. Eastern Time ("Eastern time”) and ends on June 12, 2023 at 11:59 p.m. ET ("competition period"). During the Contest Period, eligible participants are invited to submit original Mokoko-themed emote designs for the video game Lost Ark (“game") that complies with the "Submission Guidelines" (defined below). At the end of the Contest Period, a judge or jury will select up to ten (10) finalists, who will be voted on to select five (5) prize winners from among all "Entries" (as defined below). ) received during the Contest Period, as detailed below. Participation in the Contest does not constitute participation in any other promotion, contest or sweepstakes. By entering the Contest, each participant unconditionally accepts and agrees to comply with and be bound by these Official Rules and the decisions of Amazon.com Services LLC, 8329 W. Sunset Road, Suite 200, Las Vegas, NV 89113 (“Sponsor"), which will be final and binding in all respects.
ACCEPTABILITY:Only legal residents of all countries where the Game is available, who are at least eighteen (18) years of age at the time of registration are eligible to participate. For a full list of countries where the game is available, see:http://www.playlostark.com/en-us/game/faq.The Contest is not open to anyone subject to sanctions imposed by the Treasury Department's Office of Foreign Assets Control (OFAC), including anyone on OFAC's SDN List or anyone residing in Cuba, Iran, North South Korea, Sudan, Syria, or the Crimean region of Ukraine or any other country that may be added to OFAC's embargo list during the Tender Period. Officers, directors and employees of the Sponsor, Smilegate RPG, Inc., and each of their parent companies, subsidiaries, affiliates, distributors, merchants, sales representatives, advertising and promotional agencies involved in the Contest (all persons and entities collectively referred to herein document as "Subjects of market competition"), and immediate family members and/or those living in the same household are not entitled to participate in the Contest or win a prize. HOW TO REGISTER:During the Contest Period, eligible participants are invited to design an original Mokoko-themed emote for the Game (each, "emoticon design") that meets the "Entry Requirements" (defined below) using key images, graphics and other materials provided by Sponsor ("Sponsor materials"). Use of Sponsor Materials is subject to the terms appearing on the "Website" (as defined below) and the terms of these Official Rules. To enter the Contest, visit the website at https://discord.gg/playlostark (“Web page") during the contest period and fill out the entry form located on the website with all required information and attach your Emote design (the entry form and the Emote design are collectively referred to herein as "Parcel”) and follow the instructions to upload your submission to the website. All information requested in the entry form must be completed in order to enter and be eligible to win.
The submission must comply with the following:Submission requirements”: (i) except for the Sponsor Material, the Submission must be the original, unpublished work of the submitting entrant and must not contain or focus on any material owned or controlled by third parties (including, without limitation, copyrighted third party material) ; (ii) if the Submission consists of any material other than Sponsor Materials, entrant must provide, upon request, all applicable releases, permissions and releases for the Submission (in the event that entrant is unable to provide all required releases, Sponsor reserves the right, under at the sole discretion of the Client, to disqualify the applicable Submission, or seek to secure releases and approvals in favor of the Sponsor, or allow the applicable Submission to remain in the Competition); (iii) the submission must not contain images that are obscene, pornographic, defamatory or otherwise objectionable; (iv) Submission must not contain any company logo; and (v) the emoticon design must be submitted in one of the following file types: PNG or JPEG, and the file size must not exceed 25 MB.
Limit one (1) entry per eligible entrant.All entries must be received by the end of the contest period. No substitutions or new versions of submissions will be accepted after the original submission has been submitted for consideration. Any Submission that Sponsor deems, in its sole and absolute discretion, to be in violation of the Submission Requirements, in whole or in part, may be disqualified and ineligible for entry. Participant must participate only through the method of participation described above. Entries by any other person or entity and/or originating from any other website or email address, including but not limited to notices of entry into commercial sweepstakes and/or entry service websites, will declared invalid and disqualified from this Contest. . Tampering with the entry process or operation of the Contest, including, without limitation, the use of any device to automate the entry process is prohibited, and any entries that the Sponsor deems, in its sole discretion, to have been submitted in this manner will be void. In the event that the dispute regarding the identity of the person who actually submitted the application cannot be resolved to the satisfaction of the sponsor, the application concerned will be deemed ineligible. IMPORTANT NOTE: Any entrant who includes any intellectual property or proprietary material of a third party in their Submission does so at their own risk. SELECTION OF WINNERS AND NOTIFICATION: Assuming a sufficient number of eligible submissions are received by the end of the Contest Period, a judge or group of judges selected by Sponsor (in each case, “Jury”) will review the applications received and select up to ten (10) potential finalists (each, “Finalist”) based on the following criteria: (i) Emote design creativity (50%); (ii) originality of emoticon design (30%); and (iii) adaptation to the public image of the Tender subjects (20%) (“evaluation criteria"). In case of a tie, the potential finalist with the highest score in the "Creative" category will be declared the potential finalist.
The decisions of the panel of judges are final and no appeal is allowed against them. Sponsor will upload each Finalist's Submission to the Website and its affiliate social media website). he "voting period” will begin on June 16, 2023 and end on June 23, 2023. During the Voting Period, website visitors will have the opportunity to vote on the Submission they find most appealing to the public. Any entrant who offers, uses or attempts to use a "cheat," payment or other inducement or any other method of obtaining votes may be disqualified, and all votes obtained in such manner will be deemed void if Sponsor so determines in its sole discretion. . In the event of a tie, the tie will be resolved in favor of the finalist whose submission received the highest originality rating from the original judging panel. Limit one (1) vote per person and per IP address per finalist during the voting period. Any suspicious or deliberate attempt to tamper with or fraudulently manipulate the voting process may result in the disqualification of any individual or participant, at Sponsor's sole discretion.
Votes generated by scripts, macros, bots, commercial contest entry, vote-sharing websites, voting software, login service websites, or any other automated means and votes in any way that alters or is inconsistent with the voting process with the spirit of these Official Rules will override the applicable votes and may disqualify the applicable Finalist. Finalists are prohibited from soliciting votes in any fraudulent or improper manner, including, but not limited to, offering prizes, payments, or other incentives to members of the public (including, but not limited to, offering to exchange votes), as determined by Sponsor under at its own discretion. , and all associated votes may be voided and such finalists may be disqualified. The website can track votes for each submission. Rankings or vote totals published on the website are not official and should not be relied upon for any purpose. If voting is attempted beyond the limitations set forth in these Official Rules and/or in ways not expressly set forth in these Official Rules, Sponsor may, in its sole discretion, disqualify any Finalists or related votes. No cash alternative or prize substitution will be permitted, except that Sponsor reserves the right, in its sole discretion, to substitute prizes of comparable value if any specified prize is unavailable, in whole or in part, for any reason.
RIGHTS TO PRESENTATIONS: This section applies to residents of all countries except residents of France, Italy and Spain, which are listed below. By entering the Contest, each entrant acknowledges and agrees that: (a) Sponsor grants entrants a limited, non-exclusive license to use the Sponsor Materials solely in connection with and solely as part of the Contest, (b) entrants shall have no right, title or interest in the Materials Sponsor, and (c) any use of Sponsor's Materials other than as permitted by these Official Rules may violate the intellectual property rights of Sponsor or its licensors. The Sponsor cannot accurately predict the number of participants who will enter the Contest.
ADDITIONAL DOCUMENTATION: If Sponsor desires to provide such additional assignments, performance certificates of commitment or other documents as Sponsor may reasonably require to accomplish the purpose and intent of these Official Rules, then each entrant agrees to sign the same at Sponsor's request.
GENERAL DISCLAIMER OF LIABILITY / FORCE MAJEURE: Each entrant (and the parent or legal guardian of any minor entrant) agrees that the Contest Entities (A) shall not be responsible for, and hereby release, any and all costs, injuries, losses or damages of any kind, including, without limitations, death and personal injury, in whole or in part, directly or indirectly, due to participation in the Contest or any activity related to the Contest, or due to the acceptance, receipt, possession and/or use or misuse of any prize by the participant, and ( B) have made no express or implied warranty, representation or guarantee, in fact or in law, with respect to any prize, including without limitation the quality or fitness for a particular purpose of said prize. GOVERNING LAW/JURISDICTION:ALL QUESTIONS AND QUESTIONS RELATING TO THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF A CO-PAYER OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF WASHINGTON WITHOUT GOVERNING ANY CHOICE OF RULES OR PROVISIONS. However, if subsection (vi) is found to be invalid, unenforceable or illegal, this entire arbitration provision will be null and void, and neither Participant nor Sponsor will be entitled to arbitrate its dispute.
